Indochine Counsel is pleased to release its latest Industry Spotlight on Circular No. 11/2026/TT-BNNMT, which introduces regulations on the management and operation of Vietnam’s National Registration System for Greenhouse Gas Emission Quotas and Carbon Credits.
Issued by the Ministry of Agriculture and Environment and effective from 30 March 2026, Circular 11 marks an important step in the development of Vietnam’s carbon market infrastructure. The Circular provides regulations on account registration, account management, emission quota and carbon credit identification, transactions on the National Registration System, ownership transfers outside the carbon trading system, and enterprise compliance responsibilities.
As Vietnam continues to develop its legal framework for greenhouse gas emission management and carbon credit transactions, businesses in carbon-intensive sectors, ESG-driven industries, infrastructure, manufacturing, energy, finance, and investment should begin assessing how these new mechanisms may affect their compliance obligations, transaction planning, and broader sustainability strategy.
This Industry Spotlight highlights key legal considerations under Circular 11, including:
- entities eligible for account registration;
- rules on registered accounts and functional sub-accounts;
- national identification codes and serial numbers for greenhouse gas emission quotas and carbon credits;
