On 19 November 2025, Indochine Counsel participated as speaker panel in HR2B Webinar, titled “Updates on Work Permit Regulations for Foreign Employees under Decree 219/2025/ND-CP”. The session brought together more than 135 HR professionals, compliance officers, and foreign-invested enterprises seeking clarity on Vietnam’s recently updated regulatory framework, which has been in effect since 7 August 2025.
As Vietnam continues refining its labour and immigration management policies, understanding the new requirements for employing foreign nationals has become essential for employers operating in the country.
Representing Indochine Counsel were:
- Mr. Phan Anh Vu, Partner | Co-Head of Corporate and M&A, Projects & Infrastructure
- Ms. Le Thi Khanh Hoan, Partner | Head of Employment, Regulatory & Compliance
- Ms. Ho Nguyen Anh Thu, Junior Associate
During the session, the speakers provided a clear and practical overview of the new rules introduced under Decree 219/2025/ND-CP, focusing on how they differ from previous regulations and the compliance obligations now required of employers. The presentation highlighted the consolidated procedures for work permit applications, revised criteria for job positions, and updated standards for professional experience applicable to executive directors, experts, and technical workers.
Key points shared during the webinar included:
Regulatory Updates
- Consolidated steps for work permit issuance, reissuance, and extension
- Adjustments to experience requirements for foreign employees in key positions
- A newly recognized form of foreign labour assignment
- Additional rules on health certificates, multi-location work, and reporting duties
Practical Compliance Considerations
- Correctly classifying job positions and sector codes
- Preparing accurate recruitment evidence under current regulations
- Completing Form No. 03 with attention to job categories and working arrangements
- Avoiding common pitfalls such as improper legalization of documents or misidentifying exemption cases
These updates serve as a timely reminder that HR compliance for foreign employees requires not only understanding the law but also applying it accurately in practice to minimize administrative risks.
Finally, we would like to thank HR2B for providing a valuable platform for exchanging practical insights on Vietnam’s evolving work permit framework.
