Indochine Counsel is pleased to share that Ms. Le Thi Khanh Hoan, Partner | Head of Employment, Regulatory & Compliance and Ms. Ho Nguyen Anh Thu, Junior Associate, have contributed an article to the BeLuxCham Knowledge Center: Doing Business in Vietnam series. Their article, “Latest Changes in Vietnam’s Social Insurance Laws 2024,” provides a clear overview of the key updates that will take effect from 1 July 2025 under the Social Insurance Law (LSI 2024) and Decree 158/2025/ND-CP.
In the article, Ms. Thu and Ms. Hoan explain new requirements for non-salaried managers. These individuals must participate in compulsory social insurance and may select a contribution base within the statutory minimum and maximum levels. The authors also outline priority rules that apply when managers work for multiple enterprises to prevent duplicate contributions.
The article clarifies the groups that are excluded from compulsory social insurance. These include probationary employees, individuals already receiving monthly benefits, and part-time workers whose wages fall below the minimum contribution base. The updates aim to help enterprises determine eligibility more accurately.
They also address changes to the salary basis for contributions. Regular payments such as job-based salary and allowances are included in the calculation, while one-off benefits like performance bonuses and meal allowances are excluded. The shift from a fixed “base salary” to a government-determined “reference level” is another major change intended to make the system more flexible and responsive.
The enforcement framework under LSI 2024 is strengthened. Employers that delay contributions must pay the outstanding amount and daily interest. Intentional evasion may result in administrative penalties, criminal liability, and compensation for employees. Enterprises are encouraged to review payroll processes and ensure accurate, timely contributions.
