As of 1 July 2025, the Law on Fire Prevention, Firefighting, Rescue And Salvage 2024 (“Law on FFRS 2024”) officially takes effect. At the same time, the Government has promulgated Decree No. 105/2025/ND-CP (“Decree 105”), which provides detailed guidance and implements several provisions of the Law on FFRS 2024. One notable new requirement under these regulations is the preparation and management of the Fire Prevention, Firefighting, Rescue And Salvage Dossiers (the “FFRS Dossiers”).
Expansion of entities required to prepare and maintain FFRS Dossiers
Previously, the obligation to prepare the Fire Prevention and Firefighting Dossiers (the “FF Dossiers”) applied to two groups of facilities: (i) those under the management of the Police Authority and (ii) those under the management of the Commune-level People’s Committee. These classifications were determined based on criteria such as the number of floors, total floor area, volume, and other structural characteristics.
Under the new regulations, the obligation to prepare the FFRS Dossiers now applies uniformly to a consolidated group of facilities referred to as facilities subject to fire prevention, fighting, and rescue management (“Facilities”). Facilities are defined as any buildings, structures, or locations used for residential, manufacturing, business, commercial, working, or other lawful purposes, and included in the list specified by the Government under Decree 105.
Compared with the previous regulations, the criteria for determining whether Facilities are required to prepare FFRS Dossiers (such as the number of floors, total volume, etc.) have generally been revised by lowering the thresholds, thereby expanding the scope of Facilities subject to this obligation. For certain categories of Facilities, no criteria such as number of floors or total volume apply, meaning that all such Facilities are now required to prepare FFRS Dosiers (e.g., apartment, building, kindergartens, schools of all levels, markets, commercial centers, supermarkets…). Overall, the legal framework on fire prevention, rirefighting, rescue and salvage is being strengthened towards tighter regulation and enhanced oversight of entities subject to fire safety management.
The FFRS Dossiers
Under the Law on FFRS 2024, more detailed rules on rescue and salvage operations have been introduced. The change of the law’s title reflects the broader scope of regulation and aligns with the newly supplemented provisions. In line with this adjustment, the former “FF Dossiers” have also been updated and consolidated under the new name “FFRS Dossiers.”
Decree 105 revises the documents of the FFRS Dossiers by introducing several new documents, increasing the number of mandatory items, and removing outdated ones. To ensure compliance, relevant Facilities must update and use the new templates promulgated under the Decree, replacing the previous versions that are now invalid.
The FFRS Dossiers are divided into two groups of documents as follows:
1. Mandatory Documents
- Information sheet;
- Internal regulations on FFRS;
- Decision on the establishment of the grassroot or the specialized FFRS team or the written assignment of the person performing the task at the grassroots; Notification of the results of professional training in FFRS;
- FFRS plan;
- Monitoring book of FFRS equipment;
- Record of self-inspection of fire prevention and firefighting;
- Report on the results of FFRS implementation;
- Certificate of compulsory fire and explosion insurance (where applicable);
- Certificate or document of design appraisal and approval on fire prevention and firefighting design, or Acceptance of fire prevention and firefighting results (where applicable);
- Drawings of as-built fire prevention and firefighting systems and items (where applicable);
- Record of fire prevention and firefighting in spection of the Commune-level People’s Committee or Police Authority or the specialized construction agency directly managing the facility.
2. Non-mandatory Documents
- Notification of the result of verification and settlement of the fire incidents by Police Authority;
- Records of administrative violations; Decisions on sanctions related to FFRS; Decisions on suspension or resumption of operation of authorised persons; Proposals on fire prevention and firefighting of the Commune-level People’s Committees or Police Authority, specialized construction agencies directly managing the facility;
- Document of assigning persons in-charge to carry out fire prevention and firefighting in spection at the facility.
The head of the facility must conduct internal inspections and prepare seft-inspection records every 6 months or once a year, depending on the classification; and submit reports on the implementation of fire prevention and firefighting activities to the competent authority no later than 15 June and 15 December each year.
Recommendations for Enterprises/Facilities
To mitigate unnecessary legal risks, enterprises should review and fully comply with all requirements on the preparation and management of FFRS Dossiers for all facilities under their management. Administrative penalties have been significantly increased compared to previous regulations, with fines of up to VND 3,000,000 for failing to maintain sufficient documents in the FFRS Dossiers and up to VND 7,000,000 for failing to prepare the FFRS Dossiers altogether.
